نبذة عن شروط الادعاء بالحق المدني وفقًا لقانون الإجراءات الجنائية. تنص المادة 251 مكرر من قانون الإجراءات الجنائية على أنه: "لا يجوز الادعاء بالحقوق المدنية وفقًا لأحكام هذا القانون إلا عن الضرر الشخصي المباشر الناشئ عن الجريمة، والمحقق الوقوع حالًا أو مستقبلًا." وبناءً عليه، يُعد الادعاء بالحق المدني أمام المحكمة الجنائية وسيلة قانونية تمكّن المجني عليه من المطالبة بالتعويض المادي عمّا لحق به من أضرار مباشرة نتيجة الجريمة المرتكبة من قِبل المتهم، وذلك بهدف التخفيف من الخسائر التي تكبّدها بفعل هذا الضرر. فعلى سبيل المثال: إذا قام أحد الأشخاص بقطع سير المركبات بشكل مفاجئ، منتقلاً بسيارته من أقصى يسار الطريق إلى يمينه دون مراعاة لقواعد المرور، مما أدى إلى اصطدامه بسيارة أجرة (تاكسي) وتسبّب ذلك في إحداث أضرار جسيمة بالسيارة، واضطر مالكها لإصلاحها في مركز صيانة معتمد، وتكبد نفقات مالية كبيرة نتيجة لذلك، فضلًا عن تعطله عن عمله لفترة معينة، فإنه يحق له في هذه الحالة التدخل في الدعوى الجنائية مدعيًا بالحق المدني، مطالبًا بالتعويض عن الأضرار المادية الفعلية التي لحقت به، ...
